Property Law

This is an area of property law that deals with legal and statutory processes required to effect the transfer of ownership of real estate from one individual to another. Buying and selling property is a transaction in which a persons’ rights to the title are at stake, as well as large amounts of money being involved. It is always useful to involve a professional in the decision-making process.

South African law requires specialist conveyancers to execute these mandates and K Asmall Attorneys are adequately equipped to deal with these mandates.

Our services include:

  • Residential property transfers
  • Drafting of Purchases and Sales Agreements
  • Drafting of Lease Agreements
  • Commercial property transactions

It depends on the complexity of the matter and how the other side responds.

We have never lost a case but if we do, it’s not from a lack of doing everything possible to give our clients the relief they seek. We give our best to each matter but cannot control which way the presiding officer rules on the day.

It is not possible to quote accurately for legal work, because of the uncertainty of the actual amount of time that will be spent working with the file. Any quotation given regarding the costs of a matter is merely intended to give our client a rough estimate of the expected costs.

Online advice is given at a fee. However, should we realise that the advice required is more complicated than initially thought, the client will need to make an appointment, as it is difficult to properly help someone if we don’t have all the facts.
